If you applied to the EU Settlement Scheme

If your decision was made on or after 5 October 2023

You will not be able to apply for an administrative review.

If your decision was made before 5 October 2023

Your time limit for requesting an administrative review against an EUSS decision has now expired.

It may still be possible to submit an out of time administrative review if you can show evidencethat you applied as soon as you could and the Home Office is satisfied that it would be unjust not to waive the time limit.

If you want to make an out of time application for an administrative review, youll need to complete theadministrative review application form online and explain within why it has been submitted out of time.

You must use a separate form for each person applying for a review, whether theyre a child or an adult.

If youre still waiting for a decision

If you made a valid application for an administrative review before 5 October 2023, it will continue to be considered and decided unless it is withdrawn.

Fees

It costs 80 per person to apply for an administrative review.

The fee for your administrative review will be refunded if either:

  • the original decision is withdrawn due to a caseworking error
  • your application for a review is rejected because its invalid

The fee will not be refunded if your decision is changed solely because youve submitted new information or evidence.

Sending new information or evidence

You can send new information or evidence with your application for an administrative review. The application form explains how to send this.

You do not need to resend information or evidence that youve already provided to us.

How long it takes to get a decision

We have experienced unprecedented levels of applications which is causing a delay to our usual service.

It can take 18 months or more to receive the result of your administrative review. If we have not been able to decide your application within 6 months, well contact you to update you on the situation.

Any delay beyond our usual service standards will not impact the way your application is assessed, or the outcome of your application.

Withdraw your request

To ask to withdraw your request for an administrative review, please email EUSS.Admin.Review.Enquiries@homeoffice.gov.uk. You must include:

  • EUSS followed by your Unique Application Number in the subject line
  • your name, date of birth and nationality in the email

If you choose to withdraw your request for an administrative review, you may still appeal against the original EUSS decision. If you are in theUK, you have 14 days beginning from the date you e-mailed the Home Office that your administrative review be withdrawn in order to bring an appeal. If you are outside the UK, you have 28 days from the date on which you emailed the Home Office requesting that your administrative review be withdrawn in order to bring an appeal against the original EUSS decision.

Your application for an administrative review will be treated as withdrawn if you make a valid application to any of the following:

  • EU Settlement Scheme
  • EU Settlement Scheme Family Permit
  • S2 Healthcare Visitor visa
  • Service Providers from Switzerland visa

If you withdraw your request for an administrative review, or we treat it as withdrawn, your application fee will not be refunded.
