Consultation outcome: Allowing non-physical guided transport modes to be authorised by a Transport and Works Act order

A consultation took place between 31 March 2020 to 12 May 2022, which sought views on changes to the Transport and Works Act (Guided Transport Modes) Order 1992 to allow for transport guided by non-physical means. This could cover transport systems using simple sensor systems to detect paint or other road markings to direct a vehicle or more complex sensor systems which read the surrounding environment to direct a vehicle.

We received 16 responses with broad support for the legislative change set out. The government will therefore proceed with changes to the Transport and Works Act (Guided Transport Modes) Order 1992. When the change comes into force, this will allow the Secretary of State or the Welsh Government to approve Transport and Works Orders for schemes using transport guided by non-physical guidance systems.

Consultation description

This consultation seeks changes in planning legislation to allow for the use of non-physical guidance systems in orders made under the Transport and Works Act 1992 (TWA).

The change being proposed is intended to support innovation and the deployment and use of new and more advanced technologies.

Orders made under the TWA can authorise physically guided transport systems such as those guided by cables or tracks. Changes in technology mean, however, that transport can also now be guided by non-physical means.

Non-physical guided transport modes could be using simple sensor systems to detect road markings and direct a vehicle. More complex non-physical guidance systems could include those that read the surrounding environment to direct a vehicle.
