Guidance: Court of Protection visitors and the release of their reports

Court of Protection visitors report independently to the Public Guardian and theCourt of Protection. They help in the Public Guardians role of:

  • supervising deputies
  • investigating concerns about the actions of a deputy or attorney

Depending on the circumstances, a report may be released:

  • to people a visitor has interviewed while preparing a report (at the Public Guardians discretion)
  • to people or organisations included in a Public Guardian application to the court
  • to the police or a local authority involved in an investigation
  • after a request for personal information under the Data Protection Act (known as a subject access request)
  • with the courts permission, if it ordered the report
