Guidance: Release of visitors' reports: Public Guardian practice note

Court of Protection visitors report independently to the Public Guardian and the Court of Protection. They help in the Public Guardians role of:

  • supervising deputies
  • investigating concerns about the actions of a deputy or attorney

Depending on the circumstances, a report may be released:

  • to people a visitor has interviewed while preparing a report (at the Public Guardians discretion)
  • to people or organisations included in a Public Guardian application to the court
  • to the police or a local authority involved in an investigation
  • after a request for personal information under the Data Protection Act (known as a subject access request)
  • with the courts permission, if it ordered the report
