This application was made under Section 108A(1) of the Trade Union and Labour Relations (Consolidation) Act 1992. Mr Eager made a complaint of a breach of a union rule relating to balloting of the unions members on proposed rule changes. The Certification Officer struck out the complaint under section 256ZA of the Trade Union and Labour Relations (Consolidation) Act 1992 on the basis that it had no reasonable prospect of success.
