If you applied to the EU Settlement Scheme

Youll be told in your decision notice if you can apply for the decision on your application under the EU Settlement Scheme to be reviewed. This is called an administrative review.

Youll find your decision notice attached to the email we sent you following your application under the scheme.

You can apply for an administrative review if either:

  • your application was refused on eligibility grounds
  • you were granted pre-settled status but think you qualify for settled status

You can apply for an administrative review from inside or outside the UK.

If your settled or pre-settled status was cancelled at the border

Youll be told in the letter given to you at the border if you can apply for the decision to cancel your settled or pre-settled status to be reviewed.

You can apply for an administrative review if your settled or pre-settled status was cancelled because:

  • there has been a change in your circumstances
  • you gave false information

You can apply for an administrative review from inside or outside the UK.

If you arrived with an EU Settlement Scheme family permit and your leave was cancelled at the border

Youll be told in the letter given to you at the border if you can apply for the decision to cancel your leave under the EU Settlement Scheme to be reviewed.

You can apply for an administrative review if your leave was cancelled because:

  • there has been a change in your circumstances
  • you gave false information

You can apply for an administrative review from inside or outside the UK.

How to apply

If you want to apply for an administrative review, you must do so within 28 days of the date on your decision email.

Youll need to complete the administrative review application form online.

You must use a separate form for each person applying for a review, whether theyre a child or an adult.

If youre in immigration detention on the date you get your decision

If you want to apply for an administrative review you must do so within 7 calendar days of the date you get your decision.

Fees

It costs 80 per person to apply for an administrative review.

The fee will be refunded if:

  • the original decision is withdrawn due to a caseworking error
  • your application for a review is rejected because its invalid

The fee will not be refunded if your decision is changed solely because youve submitted new information or evidence.

Sending new information or evidence

You can send new information or evidence with your application for a review. The application form explains how to send this.

You do not need to resend information or evidence that youve already provided to us.

Get a decision

Were currently experiencing unprecedented levels of applications which is causing a delay to our usual service.

It can take 12 months or more to receive the result of your administrative review. If we have not been able to decide your application within 6 months, well contact you to update you on the situation.

Any delay beyond our usual service standards will not impact the way your application is assessed, or the outcome of your application.

Withdraw your request

To ask to withdraw your request for a review, please email EUSS.Admin.Review.Enquiries@homeoffice.gov.uk. You must include:

  • EUSS followed by your Unique Application Number in the subject line
  • your name, date of birth and nationality in the email

If you withdraw your request for an administrative review, your application fee will not be refunded.
