We have opened an operational consultation being made to the Cost Assessment Guidance (CAG) to move civil court assessed claims to be handled by the LAAs civil finance team instead of the courts.

Providers have the option to start sending them to us now, should they wish using the guidance below. It will be mandatory to use the LAA after the transfer date. We will confirm when this has been agreed.

Previously proceedings that concluded in front of a District Judge, where costs incurred were over 2,500, the court would conduct the assessment.

The following guidance can be used to help you claim based on how far along the assessment process your claim is. The step-by-step guide contains details on how to create your claim in the Client and Cost Management System (CCMS).

Inter partes

Where there is an inter partes element to your claim, the court will retain the right of assessment. These claims should continue to be prepared as normal. For reporting these cases to the LAA, you can refer to the CCMS Advanced Guide Submitting Outcomes and Discharge.
