There is a statutory duty for the government to consult the Advisory Council on the Misuse of Drugs (ACMD) on changes to the Misuse of Drugs Regulations 2001.

Chris Philp, Minister of State for Crime, Policing and Fire, wrote to the ACMD on 9 June 2023 for their advice on 2 aspects:

  1. The appropriate scheduling of nitrous oxide under the 2001 regulations.
  2. How to enable non-medical, lawful uses, including industrial uses.
