UK Visas and Immigration guidance on how staff make decisions on section 3C and 3D leave. This prevents an individual from becoming an overstayer while they are awaiting or appealing a decision.
A person becomes an overstayer if they remain in the UK beyond the period of their leave. This is a criminal offence under section 24 of the Immigration Act 1971.

The guidance has been amended to reflect caselaw that where a decision is withdrawn section 3C resurrects from the time the decision is withdrawn.
