Guidance: Temporary storage of waste sandbags after a flood: RPS 168

This regulatory position statement (RPS) does not change your legal requirement to have an environmental permit for a waste operation when you temporarily store waste sandbags at collection points.

However, the Environment Agency will not normally take enforcement action if you do not comply with this legal requirement if you meet the requirements in the RPS.

The regulatory position does not apply to any other legal requirements.

  1. We have updated this RPS to the latest template. The next review date is 30 September 2026.

  2. We have updated this RPS - you must now assess the sandbags to determine whether they may be hazardous waste. This will affect how they should be stored.
